These Terms of Service (hereinafter referred to as "Terms") govern the use of the AquaScan app (hereinafter referred to as "Application") provided by freeweb (hereinafter referred to as "Provider"). By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

1. Changes to Terms
The Provider reserves the right to modify these Terms at any time without prior notice to you. Revised Terms will become effective upon posting on this page. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms. You are advised to review this page periodically.
2. License Grant
Subject to these Terms, the Provider grants you a non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes. This license does not constitute a sale or transfer of ownership.
You may not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application
- Modify, adapt, or create derivative works based on the Application
- Redistribute, sell, lease, lend, or sublicense the Application
- Copy, extract, or scrape content that constitutes the Application (unless expressly permitted by the Provider)
3. Prohibited Conduct
In using the Application, you agree not to:
- Violate any applicable laws, regulations, or public order and morals
- Infringe upon the intellectual property rights, portrait rights, privacy rights, or other rights of the Provider or any third party
- Cause disadvantage or damage to the Provider or any third party
- Place excessive load on the servers or networks providing the Application
- Attempt unauthorized access to the Application or its systems
- Circumvent or disable security features of the Application
- Interfere with the operation of the Application
- Engage in any other conduct that the Provider deems inappropriate
The Provider may suspend your use of the Application without prior notice if you violate this section.
4. Intellectual Property
All copyrights, trademarks, and other intellectual property rights in the Application and all associated content, designs, graphics, code, text, logos, and other materials belong to the Provider or its rightful third-party licensors. The license granted under these Terms does not constitute a transfer or sublicense of any intellectual property rights.
5. Privacy
The collection and handling of personal information and usage data in connection with the Application is governed by our Privacy Policy. In the event of a conflict between these Terms and the Privacy Policy, the Privacy Policy shall prevail.
6. Third-Party Services
The Application utilizes third-party services including Google (Firebase, AdMob, Google Analytics), OpenAI, and others for purposes such as AI-powered fish identification, ad delivery, and usage analytics. Your use of these third-party services is subject to their respective terms of service and privacy policies. You agree to comply with such terms when using the Application.
7. Disclaimer Regarding AI Identification Results
AI-powered fish identification results provided by the Application are offered for informational purposes only. The Provider does not guarantee the accuracy, completeness, or usefulness of such results. Any actions taken based on identification results (including judgments regarding edibility, fishing activities, etc.) are at your own risk. For harmful or protected species, please always verify with expert sources or relevant authorities.
8. Disclaimer of Warranties
The Application is provided "AS IS" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. Use of the Application is at your sole risk.
The Provider does not warrant that:
- The Application will function error-free or without defects
- The Application will meet your specific requirements
- The Application's features will be continuously available
- Information within the Application is accurate, complete, or up-to-date
9. Limitation of Liability
Except in cases of willful misconduct or gross negligence by the Provider, the Provider's total aggregate liability arising out of or related to the Application shall be limited to 1,000 JPY.
In no event shall the Provider be liable for any indirect, incidental, special, consequential, or punitive damages (including but not limited to lost profits, data loss, or business interruption) arising out of or related to the use or inability to use the Application.
10. Modification and Termination of Service
The Provider reserves the right to add, modify, restrict, or discontinue any features of the Application at any time without prior notice. The Provider shall not be liable for any damages resulting from the modification or termination of the service.
11. Termination
You may terminate the license granted under these Terms at any time by uninstalling the Application from your device.
The Provider may terminate the license if you breach these Terms, without prior notice. Upon termination, Sections 4 (Intellectual Property), 7 (Disclaimer Regarding AI Identification Results), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), and 13 (Governing Law and Jurisdiction) shall survive and remain in full force and effect.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable by law, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent of the parties.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any and all disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Chiba District Court or the Tokyo District Court as the court of first instance.
